It is the constitutional law, and it should come first, forget this act or that act. Or this law or that law, or this bylaw or that bylaw.
A cop should be arresting constitutional violators, or at least refusing to detain or arrest someone on constitutional grounds.
No censorship arrests (these have happened in many places), no arrests for tools of personal security, no arrests for individuals without proper due process guaranteed. Cops should be well versed in it, and have it visible everywhere they are, work related.
There should be no bad searches, there should be no bad arrests.
On the other hand, well double Jeopardy is not a thing in Canada, but if it were, Conditional Release is not a paid debt, and not a full term. Therefore they are still guilty and at large and fair game for re-arrest and charges as predatory sex offenders and/or killers. Send them back to corrections, who will likely try to release them again for another Shane Black movie, but none the less, keep returning them to sender.
